Indefinite Detention Bill

WASHINGTON -- Accusing the Senate of "political micromanagement" of national security, the White House Friday stood by its threat to veto a defense bill over controversial military detention provisions.
The National Defense Authorization Act passed Thursday by the Senate contains a section that spells out the military's power to detain Americans indefinitely without trial and mandates military detention for some terrorism suspects.
The White House warned last month that senior advisers would recommend a veto, saying the detainee provisions could restrict the ability of law enforcement to combat terrorism and "make the job of preventing terrorist attacks more difficult."

Statement from the Center for Victims of Torture

St. Paul, MN – Since the capture and killing of Osama bin Laden, there has been a small but

vocal group calling for the return to policies of torture and cruel treatment of detainees. A leader

of this group is former Vice President Dick Cheney, who vigorously defends the previous

Administration’s unlawful and misguided interrogation policies in his memoir and during

subsequent national media appearances.

Over the past few months, the Center for Victims of Torture (CVT) has been actively engaged in

calling upon President Obama and senior members of his Administration to reassert the Obama

Administration’s renunciation and rejection of torture. That is why we welcome the news that, in a

 

span of one week, two high-ranking officials in the Obama Administration, Assistant to the

President for Homeland Security and Counterterrorism John O. Brennan and Attorney General

Eric H. Holder, Jr., made unequivocal statements that this Administration will not use torture.1

It is clear this Administration will not violate the rule of law, undermine our national security and

imperil our moral leadership throughout the world.

We know there is still work to be done. We continue to work with other human rights groups to

prevent the use of sleep deprivation, prolonged isolation and indefinite detention. Such treatment

rises to the level of cruel, inhuman and degrading treatment and has serious physical and

psychological consequences.

CVT will not cease in our efforts to ensure that no future presidency slips back to official policies

of torture. We remain committed to the establishment of an independent, nonpartisan commission

to investigate the use of torture and cruelty in counterterrorism activities post-September 11,

2001.

"حضروا للقبض علي فى الليل حين كانت الكهرباء مقطوعة عن المنطقة، ليتأكد لهم أن أسرتي لن تتعرف عليهم. ثم تم أخذي إلى مكاتب الأمن الشهيرة فى شرق مدينة نيالا— إلى تلك المكاتب التى نالت شهرتها فى ولاية دارفور كأحد اسوأ بيوت الأشباح على الإطلاق. لقد كان التعذيب الذى نلته فظيعا ومتعدد الأساليب. ولكنه وإن كان قد إشتمل على الضرب والجلد والصعق بالكهرباء والضغط النفسي والبدني وغيرها من الأساليب— فإن أسوأها جميعا، أنهم أمروني بالمشي، حافى الأقدام، على زجاج مهشم. وحين رفضت الإنصياع لهم، صعقوني بالكهرباء، فسقطت على الزجاج المهشم، ولا زلت أحمل ندبات جراحي من تلك التجربة المخيفة."

ا مرة أخرى والمجموعة السودانية لمناهضة التعذيب تترقب يوم الأمم المتحدة العالمي لمساندة ضحايا التعذيب بتفاؤل يعتريه الحذر. إن فى البيت الأبيض الآن لاشك إدارة أفضل وأكثر إلتزاما نحو وضع نهاية للتعذيب، ونحو إغلاق معتقل جوانتانمو الشهير. إلا أننا بدأنا نسمع نفس الجدل القديم مجددا بعيد القبض على أسامة بن لادن ومقتله. ذلك الجدل الذى يرجح كفة التعذيب.
لابد للتعذيب أن يتوقف. ولكي يتحقق ذلك، لابد أن يتم الكشف عمن يقفون خلفه. وإننا لندين ذلك التصريح الذى أدلى به بيتر كينج عضو الكونغرس الأمريكي عن ولاية نيويورك بشدة. الذى أعلن متباهيا، فى مقابلة له مع قناة فوكس، أن أسلوب الإيهام بالغرق قد ساعد فى العثور على أسامة بن لادن.
إن حالة حقوق الإنسان لا تبدو مبشرة على الإطلاق فى السودان. فقد أصبح نظام الرئيس عمر البشير أكثر قسوة فى إستخدامه للتعذيب والإغتصاب كوسائل لقمع الناشطين السلميين خلال السنة المنصرمة. ولقد إستمرت هذه الممارسات حتى أصبحت بمثابة السياسة الرسمية؛ خاصة منذ أن أصدرت المحكمة الدولية عريضة الإتهام، وما تبعها من مذكرة القبض على عمر البشير.
إن ما اقتبسناه هنا من شهادة إبراهيم أبكر لهو كفيل بأن يعطينا لمحة سريعة عن الحالة المأساوية فى منطقة دارفور. ولقد تسنى لنا الحديث معه الأسبوع الماضي فى نيالا بولاية دارفور، وكان حينها قد تم إطلاق سراحة قبيل شهر واحد. وقد كلفته معارضته السلمية لنظام الرئيس عمر البشير أن قبض عليه وتعرض للتعذيب مرات عديدة. فى هذه الشهادة كان إبراهيم أبكر يتحدث عن إعتقاله الأخير فى مايو من عام 2011. وكان ذلك نتيجة لمشاركته فى مظاهرة سلمية حين زار نائب الرئيس السوداني منطقة دارفور.
أعضاء المنظمة السودانية لمناهضة التعذيب يجددون مبادرة السنة الماضية لأجل بدء العمل على تفكيك منظومة التعذيب بناء على ما نصت عليه إتفاقية السلام الشامل عام 2005. وإننا نوقن أن هنالك طريق واحدة لبدء العمل على إعادة التوفيق والمعافاة، ألا وهي طريق العدالة الإنتقالية. ونجدد دعوتنا للرئيس عمر البشير لبدء إتخاذ الخطوات الآتية:
• تقديم إعتذار عام للناجين من التعذيب.
• تكوين لجان لتقصي الحقائق.
• البدء فى خطوات تعويض الناجين وأسر الضحايا.
لقد مرت أربع سنوات ولم تتخذ الحكومة السودانية أي خطوات على هذا النحو بعد، بل أن المزيد من مراكز التعذيب تفتتح كل يوم فى متفرق أنحاء البلاد. لهذا، وبما أن النظام السوداني قد فشل فى المبادرة، فإن المنظمة السودانية لمناهضة التعذيب قد بدأت فعلا فى تكويـن لجـان لتقصي الحقائق بين أفراد الشعب السوداني فى الخارج. ونحن نتمنى أن ترحب الجاليات السودانية فى مختلف أنحاء العالم بهذه المبادرة، وأن تبدأ فعلا فى تكوين لجانها لتقصي الحقائق. إن من المتوجب على كل من ساند الحكومة السودانية، وسياساتها التعذيبية، أن يتقدم بإعتذار عام. وإن من الأحرى بنا أن ندع الناجين يخبرون القصة: قصة تعذيبهم المدعوم من نظام الحكم.

فلنتكاتف ونعمل معا حتى نوقف هذه الجريمة الشنيعة.
