Statement from the Center for Victims of Torture

St. Paul, MN – Since the capture and killing of Osama bin Laden, there has been a small but

vocal group calling for the return to policies of torture and cruel treatment of detainees. A leader

of this group is former Vice President Dick Cheney, who vigorously defends the previous

Administration’s unlawful and misguided interrogation policies in his memoir and during

subsequent national media appearances.

Over the past few months, the Center for Victims of Torture (CVT) has been actively engaged in

calling upon President Obama and senior members of his Administration to reassert the Obama

Administration’s renunciation and rejection of torture. That is why we welcome the news that, in a

 

span of one week, two high-ranking officials in the Obama Administration, Assistant to the

President for Homeland Security and Counterterrorism John O. Brennan and Attorney General

Eric H. Holder, Jr., made unequivocal statements that this Administration will not use torture.1

It is clear this Administration will not violate the rule of law, undermine our national security and

imperil our moral leadership throughout the world.

We know there is still work to be done. We continue to work with other human rights groups to

prevent the use of sleep deprivation, prolonged isolation and indefinite detention. Such treatment

rises to the level of cruel, inhuman and degrading treatment and has serious physical and

psychological consequences.

CVT will not cease in our efforts to ensure that no future presidency slips back to official policies

of torture. We remain committed to the establishment of an independent, nonpartisan commission

to investigate the use of torture and cruelty in counterterrorism activities post-September 11,

2001.

ناشط من دارفور يكشف عن أسلوب جديد من أساليب التعذيب

"حضروا للقبض علي فى الليل حين كانت الكهرباء مقطوعة عن المنطقة، ليتأكد لهم أن أسرتي لن تتعرف عليهم. ثم تم أخذي إلى مكاتب الأمن الشهيرة فى شرق مدينة نيالا— إلى تلك المكاتب التى نالت شهرتها فى ولاية دارفور كأحد اسوأ بيوت الأشباح على الإطلاق. لقد كان التعذيب الذى نلته فظيعا ومتعدد الأساليب. ولكنه وإن كان قد إشتمل على الضرب والجلد والصعق بالكهرباء والضغط النفسي والبدني وغيرها من الأساليب— فإن أسوأها جميعا، أنهم أمروني بالمشي، حافى الأقدام، على زجاج مهشم. وحين رفضت الإنصياع لهم، صعقوني بالكهرباء، فسقطت على الزجاج المهشم، ولا زلت أحمل ندبات جراحي من تلك التجربة المخيفة."

ا مرة أخرى والمجموعة السودانية لمناهضة التعذيب تترقب يوم الأمم المتحدة العالمي لمساندة ضحايا التعذيب بتفاؤل يعتريه الحذر. إن فى البيت الأبيض الآن لاشك إدارة أفضل وأكثر إلتزاما نحو وضع نهاية للتعذيب، ونحو إغلاق معتقل جوانتانمو الشهير. إلا أننا بدأنا نسمع نفس الجدل القديم مجددا بعيد القبض على أسامة بن لادن ومقتله. ذلك الجدل الذى يرجح كفة التعذيب.
لابد للتعذيب أن يتوقف. ولكي يتحقق ذلك، لابد أن يتم الكشف عمن يقفون خلفه. وإننا لندين ذلك التصريح الذى أدلى به بيتر كينج عضو الكونغرس الأمريكي عن ولاية نيويورك بشدة. الذى أعلن متباهيا، فى مقابلة له مع قناة فوكس، أن أسلوب الإيهام بالغرق قد ساعد فى العثور على أسامة بن لادن.
إن حالة حقوق الإنسان لا تبدو مبشرة على الإطلاق فى السودان. فقد أصبح نظام الرئيس عمر البشير أكثر قسوة فى إستخدامه للتعذيب والإغتصاب كوسائل لقمع الناشطين السلميين خلال السنة المنصرمة. ولقد إستمرت هذه الممارسات حتى أصبحت بمثابة السياسة الرسمية؛ خاصة منذ أن أصدرت المحكمة الدولية عريضة الإتهام، وما تبعها من مذكرة القبض على عمر البشير.
إن ما اقتبسناه هنا من شهادة إبراهيم أبكر لهو كفيل بأن يعطينا لمحة سريعة عن الحالة المأساوية فى منطقة دارفور. ولقد تسنى لنا الحديث معه الأسبوع الماضي فى نيالا بولاية دارفور، وكان حينها قد تم إطلاق سراحة قبيل شهر واحد. وقد كلفته معارضته السلمية لنظام الرئيس عمر البشير أن قبض عليه وتعرض للتعذيب مرات عديدة. فى هذه الشهادة كان إبراهيم أبكر يتحدث عن إعتقاله الأخير فى مايو من عام 2011. وكان ذلك نتيجة لمشاركته فى مظاهرة سلمية حين زار نائب الرئيس السوداني منطقة دارفور.
أعضاء المنظمة السودانية لمناهضة التعذيب يجددون مبادرة السنة الماضية لأجل بدء العمل على تفكيك منظومة التعذيب بناء على ما نصت عليه إتفاقية السلام الشامل عام 2005. وإننا نوقن أن هنالك طريق واحدة لبدء العمل على إعادة التوفيق والمعافاة، ألا وهي طريق العدالة الإنتقالية. ونجدد دعوتنا للرئيس عمر البشير لبدء إتخاذ الخطوات الآتية:
• تقديم إعتذار عام للناجين من التعذيب.
• تكوين لجان لتقصي الحقائق.
• البدء فى خطوات تعويض الناجين وأسر الضحايا.
لقد مرت أربع سنوات ولم تتخذ الحكومة السودانية أي خطوات على هذا النحو بعد، بل أن المزيد من مراكز التعذيب تفتتح كل يوم فى متفرق أنحاء البلاد. لهذا، وبما أن النظام السوداني قد فشل فى المبادرة، فإن المنظمة السودانية لمناهضة التعذيب قد بدأت فعلا فى تكويـن لجـان لتقصي الحقائق بين أفراد الشعب السوداني فى الخارج. ونحن نتمنى أن ترحب الجاليات السودانية فى مختلف أنحاء العالم بهذه المبادرة، وأن تبدأ فعلا فى تكوين لجانها لتقصي الحقائق. إن من المتوجب على كل من ساند الحكومة السودانية، وسياساتها التعذيبية، أن يتقدم بإعتذار عام. وإن من الأحرى بنا أن ندع الناجين يخبرون القصة: قصة تعذيبهم المدعوم من نظام الحكم.

فلنتكاتف ونعمل معا حتى نوقف هذه الجريمة الشنيعة.

Activist in Darfur reveals new torture method

"They came to get me at night when the power was off in the area, and made sure not to be identified by my family. I was taken to the infamous security offices in north Nyala, which is known as one of the worst Ghost Houses in Darfur. The torture was severe and took many different ways such as beating, flogging, stress positions, electric shocks, etc. However, the worst method was when they ordered me to walk barefoot on broken glass and when I resisted I was electrified and fell on it. I still carry the scars from that horrific experience."

Philadelphia, PA- The Group Against Torture in Sudan (GATS) observes the United Nations International Day for Torture Survivors once again with cautious optimism. We have a better administration in the White House that is committed to stopping torture and shuting down the infamous Guantánamo Bay prison. However, after the killing of Osama bin Laden we began hearing the same old debate in favor of torture. The latest argument came from Congressman Peter King (R-NY) who bragged in an interview that Waterboarding has helped in finding Bin Laden. Torture is never justifiable and has to be stopped by exposing those behind it.

Unfortunately, the human rights picture does not look optimistic for Sudan. Over the past year, the Sudanese regime of President Omer al-Bashir became excessively ruthless in using the fear tactics of torture and rape against peaceful opposition activists. These methods became the formal policy when the President was issued an arrest warrant and indicted by the International Criminal Court. Mr. Abbaker's quote (above) gives a glimpse of the gloomy reality in the Darfur region. It refers to his latest arrest in May, 2011 when he participated in a protest rally during the visit of the Sudanese Vice President to Darfur. He had been released only one month when we spoke with him last week in Nyala, Darfur. He expressed that he had been arrested many times before and tortured due to his peaceful opposition to Sudan’s regime.

GATS members are once again offering their initiative to begin the needed steps to deconstruct the establishment of torture based on the 2005 Comprehensive Peace Agreement (CPA). There is only one way to start the healing and reconciliation, and this is by taking the Transitional Justice road. We repeat our request in 2007 to President Bashir to:

· Provide a public apology to the torture survivors
· Establish the Truth Committees
· Begin the necessary steps towards redress for the survivors and families of the dead.

Four years have passed and the Sudanese regime has not taken any step in this direction. Alarmingly, even more torture centers were opened all over the country.

Since the regime has failed to take the initiative, GATS has begun the process of Transitional Justice by forming the Truth Committees within the Sudanese Diaspora. We hope that each Sudanese community would welcome this process and host a Truth Committee.

A public apology is needed from all those who supported the torture regime in any way, even as a by-stander. Let the survivors tell the truth bout the crime of government-supported torture, and let’s all work together to stop this heinous crime of torture.

إن أشكال التعذيب تتعدد في هذا العالم و إن صور الاضطهاد و العنف تجد مساحات جديدة وان المحاكم الملفقة واستغلال القضاء كأداة من أدوات القمع تبقى قضيه تستحق الوقوف عندها واعتبارها إحدى أدوات التعذيب وان إفقار الإنسان و تجويعه و إرساله إلى المعسكرات أو الهروب إلى الجبال والغابات بحثا عن سلامته ضربا من التعذيب , وان الحديث عن الإرهاب كذريعة للتعذيب ما عادت مبرئة للذمة كلها أدوات فظيعة للتعذيب وانتهاك صارخ لحرمة الإنسان وخصوصيته.
فلنتفق جميعا ضد إشكال التعذيب الآنية التي نراها من الاغتصاب مرورا بالمحاكم الفاسدة حتى نصل الفقر والجوع والهوان. ندعو الجميع للوقوف والعمل على إلقاء ظاهرة التعذيب وحماية المواطن عبر آليات القانون واليات الحماية والتوعية والتضامن .
يصادف يوم 26 يونيو من كل عام موافقة الأمم المتحدة على اعتماد اتفاقية مناهضة التعذيب , وبعد مرور أكثر من ثلاثين عاما على الحدث ,لا زالت أجزاء كبيره من العالم تشهد استمرار ظاهرة التعذيب فأكثر من 68 % من دول العالم تمارس التعذيب بشكل ممنهج و مدروس من قبل السلطة المعنية , لتكميم الأفواه ومصادرة حقوق الإفراد و منعهم من أداء أدوارهم الانسانيه والاجتماعية .
نحن نؤمن بان سلامة و صحة المعتقل أو السجين وعدم تعرضه للتعذيب إثناء التحقيق أو الاعتقال هو حق شرعي يجب عدم المساس به وعلى الجميع أن ينحني احتراما لهذا الضعيف القوى داعمين وناصحين بضرورة إلغاء هذه الممارسة ألا إنسانية .
في الاونه الاخيره شهدت منطقة الشرق الأوسط العديد من الثورات تعاملت معها الحكومات بعنف شديد أدى للقتل في أحايين كثيرة كما شهدت حالات اغتصاب للنساء وأنواع مختلفة من الانتهاكات التي تؤكد ما ذهبنا إليه في بداية البيان ولكن المؤكد إن العنف والترهيب لم يوقف زحف الجماهير الغاضبة نحو غاياتها وان الانتصارات كانت هي المحصلة الطبيعية للنشاط الانسانى المنظم ولذلك هنالك ضرورة لمراجعة منهج العصا لمن عصى وأدوات التخويف والقهر فإنها تؤكد يوميا خورها وانتهاء اجلها .
إما السودان فرغما عن الانتهاكات الموثقة لما حدث في دارفور مازالت الانتهاكات يتم الحديث عنها نتيجة للحرب المستمرة بين الحكومة والحركات المناوئة وتضاف إليها الحرب التي اندلعت في جنوب كردفان وجبال النوبة التي تؤكد إن عملية القهر والتعذيب بإشكاله المختلفة ما عادت تراوح مكانها .
إما المواجهات المفرطة في العنف التي تمت ضد الطلاب في أكثر من مدينة نتيجة للمظاهرات المطالبة بالتغيير أدت إلى تعرض أكثر من مائة طالب للأذى الجسيم وتعرض بعضهم لصنوف مختلفة من التعذيب في الفترة القليلة الماضية , كما تعرض الأطباء لعنف غير مبرر مع تهديدهم بالقتل والفصل التعسفي من العمل نتيجة لمطالبهم الفئوية ,كما تعرض عدد كبير من الصحفيين للعنف والاعتقال والمساءلة والتهديد عبر المحاكم والمصادرة للصحف اليومية وذلك في النصف الأول من هذا العام .
إن تجدد القتال في ابيي وجنوب كردفان وما صاحبه من تشريد للمواطنين تؤكد إننا سنشهد موجة أخرى من التهجير والاضطهاد والتعذيب.
وفي ذكرى التضامن مع الناجين من التعذيب , لابد من العمل بهمة عاليه من اجل ترسيخ المبادئ الديمقراطية, والتناصح والاستماع للرأي والراى الأخر , واحترام حقوق الآخرين والتوافق على تعديل القوانين التي تفتح الفرصة للتعذيب وغيره من ضروب هذا الفعل ألا انسانى و مراجعة كل الحصانات الممنوحة للعاملين في الدولة والتامين على عدم استقلالها كأداة للوصول للتعذيب حتى نجنب بلادنا كل مظاهر العنف وإهدار الحقوق المشروعة للناس ,وما يترتب على ذلك من عنف مضاد وحروب وإشكالات مع المجتمع الدولي والإقليمي.
إن حكومة السودان ومشرعها حتى ألان يصران على عدم التصديق على اتفاقية مناهضة التعذيب ومازال النقاش يدور حول الجانب القانوني والسياسي والديني للاتفاقية فالدعوة للجميع للعمل على التصديق أولا على الاتفاقية لتكون هي المؤشر والهادي لإلغاء ظاهرة التعذيب .
واختم مناشدتي بأنه من الضروري علاج وإعادة تأهيل ضحايا التعذيب ورد الاعتبار لهم ولأسرهم والعمل على بناء مؤسسات تقوم بهذا العمل الانسانى الذي يغيب عن الساحة هذه الفترة .
